Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of IMQRScan.com and its QR code generation, dynamic redirect, digital business card, hosted page, analytics, file, form, catalogue, API and related services (collectively, the "Services"). By creating an account, purchasing a plan, generating or publishing content, or otherwise using the Services, you agree to these Terms.
1. Who May Use IMQRScan
You must be legally capable of entering into a binding agreement and, unless applicable law permits otherwise, at least 18 years old. If you use IMQRScan for a business or organization, you represent that you are authorized to bind that entity to these Terms.
2. Accounts and Account Security
You must provide accurate information and keep your account credentials secure. You are responsible for activity carried out through your account, except to the extent caused by our breach of applicable law or security obligations. Notify us promptly at support@imqrscan.com if you suspect unauthorized access.
3. IMQRScan Services
IMQRScan provides tools that may include static and dynamic QR codes, editable destinations, scan analytics, digital business cards, multi-link pages, event or product pages, file or document QR codes, forms, API access, customization, and other related functionality. Features, limits and availability may differ by plan and may change over time.
You are responsible for testing QR codes before printing, publishing or distributing them and for maintaining any destination, file, page, domain or third-party service to which a QR code links.
4. Subscriptions, Billing and Renewals
Paid plans are billed at the price and billing interval shown at checkout. Unless a plan is expressly described as non-renewing, subscriptions may renew automatically until cancelled. You authorize our payment processor to charge the applicable fees, taxes and approved recurring charges using your selected payment method.
You must cancel before the next renewal date to avoid a renewal charge. Cancellation normally prevents future renewals and does not automatically create a right to a refund for the current billing period. Refund eligibility is governed by our Refund & Cancellation Policy and mandatory applicable law.
5. Acceptable Use and Prohibited Content
You may not use IMQRScan to create, host, upload, redirect to, distribute, advertise, facilitate or promote content, products, services or activities that fall within the prohibited categories below.
- Illegal activity: content or conduct that violates applicable local, national or international law.
- Fraud and deception: scams, fraudulent schemes, impersonation, deceptive payment requests, counterfeit offers, misleading claims or attempts to obtain money or information dishonestly.
- Phishing and malicious technology: credential theft, phishing pages, malware, viruses, malicious downloads, exploit delivery, unauthorized tracking or other harmful code.
- Gambling and casinos: casinos, betting, wagering, gambling services, gambling promotions or similar activities.
- Alcohol and liquor: sale, ordering, distribution, advertising or promotion of alcoholic beverages, liquor or similar intoxicating products.
- Adult sexual content: pornography, sexually explicit material, sexual services, explicit or graphic nudity, or content primarily intended for sexual stimulation.
- Tobacco, smoking and nicotine products: cigarettes, cigars, tobacco, vaping or e-cigarette products, nicotine products, smoking-related products, or their sale, ordering, distribution, advertising or promotion.
- Abuse or exploitation: sexual exploitation, child sexual abuse material, non-consensual intimate content, trafficking, threats, harassment or content that facilitates serious harm.
- Other prohibited or restricted activity: any content that infringes intellectual property or privacy rights, promotes illegal goods or services, or creates an unacceptable security, legal or reputational risk for IMQRScan or its users.
6. Enforcement, Suspension and Termination
Where we reasonably believe a QR code, destination, hosted page, file, account or activity violates these Terms, applicable IMQRScan policies, applicable law, a valid legal request, or creates a material security risk, we may investigate and take proportionate action. This may include disabling a QR code or destination, removing hosted content, limiting features, suspending or terminating an account, preserving evidence, or cooperating with lawful authorities.
Where reasonably practicable and legally permitted, we may provide notice or an opportunity to correct a violation. We may act without prior notice where urgent action is needed to address fraud, phishing, malware, illegal activity, user safety, security risk or a legal obligation.
Payments associated with accounts suspended or terminated for prohibited use are generally non-refundable, subject to our Refund Policy and any non-waivable rights under applicable law.
7. User Content and QR Destinations
You retain ownership of content you submit to the Services. You grant IMQRScan a limited, worldwide, non-exclusive license to host, process, reproduce, transmit and display that content solely as necessary to operate, secure, support and improve the Services and to comply with law.
You represent that you have the rights and permissions necessary for content you upload or link to. You are responsible for the legality, accuracy and safety of your QR code destinations and any claims, offers, products or services presented through them.
8. Intellectual Property
IMQRScan and its licensors own the Services, software, branding, site design and original website content, excluding user content. Except as expressly permitted, you may not copy, reverse engineer, resell, sublicense, scrape, reproduce or distribute protected elements of the Services in violation of applicable law or our rights.
9. Third-Party Services
The Services may integrate with or link to third-party websites, payment processors, hosting providers, analytics providers, messaging providers or other services. Third-party services are governed by their own terms and privacy practices. IMQRScan does not control third-party content or availability and is not responsible for third-party acts or omissions except where liability cannot lawfully be excluded.
10. Service Availability and Changes
We aim to provide reliable Services but do not guarantee uninterrupted, error-free or permanent availability. Maintenance, security events, internet failures, third-party outages, legal restrictions or other events may affect availability. We may modify, add or discontinue features, provided that we do not unlawfully deprive customers of paid services already due to them.
11. Disclaimers
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis. We do not warrant that every QR code will remain scannable in every physical condition, device, camera, printing method or third-party environment. You should test QR codes before mass printing or distribution.
Nothing in these Terms excludes warranties, remedies or rights that cannot lawfully be excluded.
12. Limitation of Liability
To the maximum extent permitted by applicable law, IMQRScan will not be liable for indirect, incidental, special, consequential or punitive losses, or for loss of profits, revenue, goodwill, business opportunity or data, arising from use of the Services. Where liability may lawfully be limited, IMQRScan's aggregate liability for a claim relating to a paid Service will not exceed the amount you paid to IMQRScan for that Service during the 12 months immediately preceding the event giving rise to the claim.
These limitations do not apply where exclusion or limitation is prohibited by law, including liability that cannot legally be excluded.
13. Indemnity
To the extent permitted by law, business users agree to defend, indemnify and hold harmless IMQRScan from third-party claims arising from their unlawful use of the Services, their content or destinations, or their infringement of third-party rights. This section does not require a consumer to waive non-waivable statutory rights.
14. Privacy and Data Protection
Our processing of personal data is described in the IMQRScan Privacy Policy. By using the Services, you acknowledge that service operation may require processing of account, technical, billing, support and QR analytics information in accordance with that policy and applicable data protection law.
15. Refunds and Cancellations
Refunds, duplicate charges, technical non-delivery, renewal requests and policy-violation cases are handled under our Refund & Cancellation Policy. Nothing in that policy limits any refund or remedy required by mandatory applicable law.
16. Changes to These Terms
We may update these Terms for legal, security, operational or product reasons. The "Last updated" date will be revised when changes are posted. Where required by law or where a change materially affects an active paid subscription, we will provide additional notice where reasonably practicable.
17. Governing Law and Jurisdiction
These Terms are governed by the applicable federal laws of the United Arab Emirates and, where relevant, the laws applicable in the Emirate of Dubai, without limiting any mandatory consumer protections that apply to you. Subject to any mandatory jurisdiction rights, disputes relating to these Terms or the Services will be submitted to the competent courts of Dubai, United Arab Emirates.
18. Severability and Entire Agreement
If a provision of these Terms is found unenforceable, the remaining provisions remain effective to the extent permitted by law. These Terms, together with the Privacy Policy, Refund & Cancellation Policy, and Disclaimer, form the agreement governing use of the Services unless a separate written agreement applies.
